Australia’s Gold Coast Sweepstakes” Rules & Regulations

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  THE AUSTRALIA’S GOLD COAST SWEEPSTAKES (THE “PROMOTION” OR “SWEEPSTAKES”) IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES (INCLUDING DISTRICT OF COLOMBIA) WHO ARE AT LEAST 18 YEARS OF AGE AT THE TIME OF ENTRY AND ARE CURRENTLY ENROLLED AND ACTIVE STUDENTS.  ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

1. Sweepstakes Entities: This Sweepstakes is sponsored by StudentUniverse.com Inc., 130 Turner St., Suite 530, Waltham, MA 02453 “Sponsor” and is administered by StudentUniverse.com Inc., 130 Turner St., Suite 530, Waltham, MA 02453 “Administrator”.  Sponsor and Administrator collectively referred to herein as the “Administrator”.

2. Eligibility: Winning a prize is contingent upon fulfilling all requirements set forth herein.  Participation in this Sweepstakes is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least eighteen (18) years old at the time of entry, and who are currently enrolled and active students.

Entrants will be required to prove eligibility by providing required information including name, date of birth, address, current school, legal residency and IRS Form W-9 “Required Information”.  

Administrator’s employees, employees’ immediate family (spouse, parents, siblings and children) and household members or parent and affiliate companies, and Administrator’s suppliers as well as their immediate family (spouse, parents, siblings and children) and household members of each such supplier are not eligible.

3. Agreement to Official Rules Participation constitutes acceptance of these rules. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. How to Enter: Entrants may enter for a chance to win by submitting an entry on the StudentUniverse website https://www.studentuniverse.com/flights/flights-to-the-gold-coast by providing Administrator with “Required Information”. Entries may be submitted anytime from May 1, 2015 until May 15, 2015 (the "Promotion Period"). Limit one (1) Entry per Entrant. If more than one (1) Entry is submitted by an Entrant, only the first Entry received by that Entrant will be accepted and any subsequent Entries received from that Entrant will be void. Entries not submitted in accordance with the instructions provided in these Official Rules are subject to disqualification, in the sole discretion of the Administrator. All entries and all rights thereto become the sole property of Administrator.  Administrator reserves the right to change the end date and or time at any point during the Promotion. The end date may be changed without any form of notice, written or oral, to the participants or potential participants.

5. Entry Terms: By entering, Entrants agree to comply with StudentUniverse’s Terms of Service http://www.studentuniverse.com/students/terms-of-use.

6. Drawing, Verification and Notification of Potential Winners: One winner will be chosen on or around May 19, 2015. Winners will be selected from a random drawing. Participants must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.

On the selected dates, the name of the Prize Winner will be posted on StudentUniverse Facebook Page http://www.facebook.com/studentuniverse and an email will be sent to the Prize Winner through email provided at entry. If potential winners of any prize cannot be contacted within 72 hours of initial notification, potential winners forfeit prize.  For Sweepstakes results and/or a copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope to "Australia’s Gold Coast Sweepstakes - Winners/Rules", c/o StudentUniverse.com, Inc., 130 Turner St., Suite 530, Waltham, MA 02453.

The “Required Information” provided at entry will be verified for validity.  If any of the “Required Information” is deemed to be invalid, the potential winners forfeit prize. In the event that a potential winner of any prize is disqualified for any reason, Administrator will award the applicable prize to an alternate winner by choosing from among all remaining eligible entries. There will be three (3) alternate drawings after which the prize will remain un-awarded.

Administrator’s decisions as to the administration and operation of the Promotion and the selection of potential winners are final and binding in all matters related to the Promotion.

7. Prizes and Prize Conditions: 1 winner will receive a roundtrip flight from the United States to Gold Coast, Australia (max value of $2,500 USD), 5 night accommodations in Australia's Gold Coast, and 5 iconic excursions for a combined max value of $3,750 AUD from StudentUniverse.com Inc. during the Australia’s Gold Coast Sweepstakes being held from May 1, 2015 until May 15, 2015. The roundtrip flight must depart from either: Los Angeles Airport, New York JFK Airport, or Dallas Fort Worth Airport. The 5 night accomodations are for a 4 star hotel in Surfers Paradise and include a daily full buffet breakfast. The iconic excursions include: one entry to Currumbin Wildlife Sanctuary, one entry to Dreamworld, one entry to SkyPoint Observationa Deck, one entry to Sea World, and one ride on Paradise Jet Boating. Administrator will select 1 winner from all valid entries submitted.

Prize cannot be substituted and is not transferable or assignable. Winner is responsible for the payment of any and all federal, state and/or local taxes that may apply to such winnings. The prize cannot be used in conjunction with any other StudentUniverse or third party discounts or special offers. Flight must be booked by June 15, 2015 for travel by December 31, 2015.

In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Administrator, the Administrator reserves the right to either provide an alternative travel destination to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the Promotion.

The Administrator accepts no responsibility for any variation in the prize value. Prize, or any unused portion of the prize, is not transferable or exchangeable for other goods or services and cannot be taken as cash. Any costs incurred from changes post booking, such as a date change, are the winner’s responsibility to pay.

StudentUniverse will not be responsible for cancelled, delayed, suspended or rescheduled events or travel after ticketing for any reason beyond its control. All other terms & conditions of travel are as per the standard StudentUniverse terms and conditions.

StudentUniverse reserves the right to substitute a prize of at least equal value in the event of unavailability, for whatever reason, of the advertised prize. Should the value of any prize be less than the value stated, the difference will not be awarded in cash or in kind.

8. Release and Limitations of LiabilityThe Administrator will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability, which cannot be excluded by law (in which case such liability is limited to the maximum extent allowable by law). The Administrator will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Administrator including without limitation technical malfunctions or failures. Tax implications may arise from the receipt or use of a prize. Independent financial advice should be sought.

By receipt of a prize, winner agrees to release and hold harmless Administrator and their respective subsidiaries, affiliates, partners, suppliers, distributors, advertising/Promotion agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes receipt or use or misuse of any prize.

9. General Conditions If for any reason this Promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the control of the Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Administrator reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion subject to any written directions under applicable legislation. The Administrator also reserves the right in its sole discretion to disqualify any individual who the Administrator has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Promotion. The Administrator’s legal rights to recover damages or other compensation from such an offender are reserved.

The Administrator is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion.

All entries and any copyright subsisting in the entries become and remain the property of the Administrator. The Administrator collects contact information about entrants in order to contact them about the Promotion and where appropriate award prizes and may also use the information to assist the Administrator in improving goods and services and to contact entrants in the future with special offers via any medium including mail and commercial electronic messages. If you do not provide the information, you cannot participate.

By entering into this Promotion, the winners agree that his/her details may be used in post-event publicity including blogging on StudentUniverse's preferred blogging system before, during and / or after the trip prize. The winners may need to complete a trip report plus an interview with StudentUniverse upon their return; this must be completed within 2 weeks of return.

The Administrator decisions are final and binding in all matters relating to this Sweepstakes, including interpretation and application of these Official Rules, without prejudice of any claim that could be filed before the court. In the event of a dispute as to the identity of an Entrant the Entry in question may be disqualified in the Administrator sole discretion. The Administrator reserve the right, in their sole discretion, to disqualify any individual found tampering with the entry process or entry materials or otherwise interfering with the proper administration of the Sweepstakes or violating these Official Rules and void all associated Entries and/or votes. The Administrator may cancel, modify, or suspend the Sweepstakes (or portion thereof) due to a force majeure event or any other event beyond the Administrator reasonable control. Each Entrant hereby acknowledges and agrees that the relationship between the Entrant and the Administrator is not a confidential, fiduciary, exclusive, or other special relationship, and that the Entrants decision to submit an Entry in connection with these Sweepstakes does not place the Administrator in a position that is any different from the position held by members of the general public with regard to elements of the Entry, other than as set forth in these Official Rules.

10. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusive jurisdiction and venue of courts of, Massachusetts, for all disputes arising of or relating to the subject matter hereof; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, USA, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Massachusetts.

11. Entrant's Personal Information: Information collected from entrants is subject to StudentUniverse Privacy Policies http://www.studentuniverse.com/students/privacy-policy. Any Entrant information collected during the Sweepstakes shall be used only in a manner consistent with the consent given by Entrants, at the time of entry, and with these Official Rules.
